Widow Loses Philip Morris Wrongful Death Suit

Law360, New York (May 13, 2010, 6:35 PM EDT) -- The wife of a man who won an astronomical $3.5 billion jury verdict against Philip Morris USA Inc. for causing his lung cancer lost her own bid Thursday to get damages for the loss of her husband's companionship because of the disease.

The California Supreme Court handed down a 4-1 ruling holding that Judy Boeken's suit was prohibited by the doctrine of res judicata because it concerned the same cause of action as an earlier suit that she had filed and later dismissed.
