ConocoPhillips Can't Nix Class Claims In OT Case

Law360, New York (May 14, 2010, 1:53 PM EDT) -- The federal judge overseeing a putative overtime class and collective action against ConocoPhillips Pipe Line Co. has denied the company's motion to strike the class allegations from the plaintiff's complaint.

Judge Rebecca Pallmeyer of the U.S. District Court for the Central District of California issued a memorandum opinion and order Wednesday denying ConocoPhillips' March 3 bid to strike plaintiff Damon Ferrell's Fair Labor Standards Act and Rule 23 class allegations from his second amended complaint.
