Chinese Furniture Duties Calculation Invalid: Fed. Circ.

Law360, New York (May 14, 2010, 6:26 PM EDT) -- A federal appeals court found Friday that the U.S. Department of Commerce had improperly assessed duties on wooden bedroom furniture from China and ordered the agency to recalculate the duties.

The U.S. Court of Appeals for the Federal Circuit vacated a ruling by the U.S. Court of International Trade, which had affirmed Commerce's method for calculating the duties in an earlier ruling, and remanded the case for further proceedings.
