Massey Faces Criminal Probe Over Fatal Mine Blast

Law360, New York (May 14, 2010, 6:21 PM EDT) -- Federal prosecutors are reportedly looking into whether the operators of a Massey Energy Co.-owned mine in West Virginia engaged in any “willful criminal activity” leading up to the deadly April 5 explosion that killed 29 workers.

The U.S. Attorney's Office for the Southern District of West Virginia said that it was investigating actions undertaken by Massey subsidiary Performance Coal, the operator of the Upper Big Branch mine where the explosion took place, according to a letter obtained by the Associated Press.
