Homebuilders' Suit Slams DOI's Reading Of ESA

Law360, New York (May 21, 2010, 4:39 PM EDT) -- A construction trade group has sued the U.S. Department of the Interior and its Fish and Wildlife Service, accusing them of interpreting the criteria to list species under the Endangered Species Act too broadly.

The National Association of Home Builders filed the complaint Wednesday in the U.S. District Court for the District of Columbia, challenging a 2007 determination that allows animal and plant species to be listed under the act even if they aren't part of a "distinct population."
