Supreme Court Favors Black Would-Be Firefighters

Law360, New York (May 25, 2010, 1:51 PM EDT) -- The U.S. Supreme Court on Monday found that black firefighter applicants who charged the city of Chicago with using a discriminatory hiring test did not file their claim after a statutory time limit, reversing a lower court ruling.

Justice Antonin Scalia authored the unanimous opinion in Lewis v. Chicago, finding that the statute of limitations for a disparate impact case begins 300 days after an allegedly discriminatory practice is carried out, rather than when it is put into place.
