DC Circ. Won't Rehear Calif. Emissions Challenge

Law360, New York (June 4, 2010, 11:21 AM EDT) -- A federal appeals court says it will not review en banc its decision upholding the U.S. Environmental Protection Agency's endorsement of a California emissions standard rule for refrigerated trucks, likely ending a case that trucking industry advocates warn will set a nationwide precedent.

The full panel on the U.S. Court of Appeals for the District of Columbia Circuit on Thursday denied without comment a bid by trade group the American Trucking Associations Inc. to stage a rehearing of its April decision.
