Suit Says Sears Misclassified Managers In Calif.

Law360, New York (June 9, 2010, 12:58 PM EDT) -- The parent company of Sears and Kmart has been hit with a putative class action by assistant managers of its retail stores throughout California, who claim the company misclassified them as exempt from California's wage-and-hour laws.

The amended complaint, filed Tuesday in the U.S. District Court for the Northern District of California, accuses Sears Holdings Corp. of failing to pay its assistant managers overtime compensation, failing to provide them with meal and rest breaks and failing to pay their compensation at the time of termination, all...
