Wyeth Denied Summary Judgment

Law360, New York (January 29, 2007, 12:00 AM EST) -- A district court judge has rejected most of Wyeth’s requests for summary judgments in a case in which pharmacists accused two drug makers of fixing prices, forcing them to purchase medication from wholesalers and favoring some buyers over others.

Judge I. Leo Glasser’s decision on Thursday regarded claims by Drug Mart Pharmacy Corp., a group of pharmacists, that pharmaceutical makers Ciba-Geigy Corp. and G.D. Searle & Co. would not sell their brand name prescription drugs directly to independent pharmacists, forcing them to go to wholesalers....
