Quia Loses Bid To Block Mattel, Fisher-Price Toy

Law360, New York (June 16, 2010, 6:35 PM EDT) -- A federal judge has rejected Quia Corp.'s request for a preliminary injunction barring Mattel Inc. and its subsidiary Fisher-Price Inc. from selling an educational toy under the mark iXL, finding that consumers were unlikely to confuse the toy with the educational software company's IXL Web-based learning program for children.

Judge Jeremy Fogel of the U.S. District Court for the Northern District of California denied Quia's request Tuesday, ruling that the plaintiff had not shown it would likely succeed on the merits of its trademark infringement claim...
