Alcon Shareholders Can't Keep Merger Suit In US

Law360, New York (June 18, 2010, 1:25 PM EDT) -- Plaintiffs in a shareholder lawsuit accusing Novartis AG of shortchanging them in its $28.1 billion merger with eye care company Alcon Inc. have lost a bid for reconsideration of the court’s recent decision dismissing the case on the grounds of forum non conveniens.

Judge Victor Marrero of the U.S. District Court for the Southern District of New York said Thursday that the plaintiffs had not presented any new evidence or controlling law that would alter his previous determination that there is not jurisdiction in the U.S....
