Shareholders Withdraw Suit Against Midwest Air

Law360, New York (February 1, 2007, 12:00 AM EST) -- Midwest Air Group Inc., which has battled to thwart an unsolicited merger bid by AirTran Holdings Inc., announced Wednesday that a shareholder lawsuit involving the merger has been withdrawn.

The proposed class action, which was filed in Milwaukee County Circuit Court in Wisconsin, accused Midwest’s board of directors of breaching its fiduciary duties by failing to accept AirTran’s offer. It was voluntarily withdrawn, however, with no reason given, according to Midwest spokeswoman Carol N. Skornicka.
