EU High Court Backs €86M Cartel Fine On Knauf

Law360, New York (July 1, 2010, 11:56 AM EDT) -- The European Union's highest court upheld an €85.8 million ($106.9 million) fine against Knauf Gips KG for its alleged role in a plasterboard cartel Thursday, just two weeks after affirming a penalty against cement giant Lafarge SA for the same 1990s price-fixing plot.

The European Commission did not err in holding Knauf Gips KG liable for the anti-competitive conduct of the entire Knauf Group, the European Court of Justice ruled, pointing out that the company's subsidiaries did not have independent control over their activities.
