8th Circ. Upholds Toss Of Grounded AA Plane Suit

Law360, New York (July 7, 2010, 3:36 PM EDT) -- The U.S. Court of Appeals for the Eighth Circuit has affirmed a lower court's dismissal of a putative class action against American Airlines Inc. alleging it kept passengers grounded on a tarmac for nearly 10 hours in smelly and cramped conditions without enough food.

A unanimous three-judge panel said in an opinion Friday that plaintiff Catherine Ray had failed to prove that there was a law in effect during her delay that set a limit on the number of hours American could keep passengers on board....
