HP Fails To Nix Worker Suit Over Unpaid Commissions

Law360, New York (July 8, 2010, 1:23 PM EDT) -- Hewlett-Packard Co. has lost its bid to toss breach of contract claims in a putative class action accusing the company of failing to pay commissions and bonuses to as many as 50,000 employees due to a malfunctioning software system that tracks sales.

Judge Charles R. Breyer of the U.S. District Court for the Northern District of California mostly denied HP's motion to dismiss four former sales representatives' second amended complaint Tuesday, nixing only the California employment law claims brought by three plaintiffs who reside in Colorado....
