Calif. Court Backs Clarendon In Defense Costs Fight

Law360, New York (July 8, 2010, 7:03 PM EDT) -- A California appeals court has handed a victory to Clarendon America Insurance Co. in its battle to get fellow insurance company North American Capacity Insurance Co. to pay a part of legal defense costs incurred by a residential community developer insured by both companies.

The California Court of Appeal, Fourth District, on Wednesday reversed a trial court's decision that NAC's duty to defend Tanamera Homes and Resort Communities LLC was never triggered under its policy.
