AAI Urges 9th Circ. To Rehear Car Rental Cartel Case

Law360, New York (July 12, 2010, 1:53 PM EDT) -- The U.S. Court of Appeals for the Ninth Circuit should overturn its decision to drop the California Travel and Tourism Commission from a suit accusing it of facilitating a car rental price-fixing cartel, the American Antitrust Institute has said.

The Ninth Circuit applied an overbroad interpretation of the doctrine of “state action immunity,” the AAI said in an amicus curiae brief filed Friday.

The doctrine allows state agencies to escape sanctions for uncompetitive conduct in some circumstances, but there is no evidence the California Legislature intended...
