Alpharma Sales Reps Exempt From OT: Judge

Law360, New York (July 20, 2010, 3:10 PM EDT) -- Cleaving to a recent appeals court decision involving Johnson & Johnson employees, a federal judge has determined that Alpharma Inc.’s sales representatives are not misclassified as exempt from overtime pay.

On Monday, U.S. District Judge Garrett E. Brown Jr. of the District of New Jersey concluded that Alpharma’s sales reps in fact qualify for the administrative exemption to the Fair Labor Standards Act overtime requirements, noting that the plaintiffs’ salaries and relative autonomy at work undercut claims they are entitled to time and a-half rates....
