Pfizer Gets Off-Label Suit Over 12 Drugs Tossed

Law360, New York (July 20, 2010, 7:43 PM EDT) -- A federal judge has thrown out a putative class action that accused Pfizer Inc. and Pharmacia & Upjohn Co. of fraudulently marketing a dozen drugs including Geodon, Lyrica, Lipitor and Zoloft, and promoting the drugs for off-label uses.

Judge J. Curtis Joyner of the U.S. District Court for the Eastern District of Pennsylvania granted Pfizer's motion to dismiss Kathleen Zafarana and Brad Dumville's amended complaint Monday, and said any future amendment to the complaint would be futile.
