DC Circ. Rejects Challenge To Calif. Power Rates

Law360, New York (July 26, 2010, 1:26 PM EDT) -- A federal appeals court has rejected California utilities' challenge to several Federal Energy Regulatory Commission orders implementing tariff changes as part of a redesign and upgrade of the state's electricity market.

A three-judge panel in the U.S. Court of Appeals for the District of Columbia Circuit on Friday denied the petitioners' request for review of four FERC orders, finding no merit to their opposition to the locational marginal pricing rate design, the local adequacy requirement and the congestion revenue mechanism in the revised tariff orders....
