Cable One Loses Bid To Nix Cable Box Tying Action

Law360, New York (July 29, 2010, 2:06 PM EDT) -- A federal judge has refused to dismiss a putative antitrust class action accusing Cable One Inc. of violating the Sherman Act by forcing customers to rent a cable box as a condition of receiving premium service.

Judge Halil S. Ozerden of the U.S. District Court for the Southern District of Mississippi said in a four-page order Wednesday that dismissal was premature and that named plaintiff Linda Scott should be afforded an opportunity to conduct discovery.
