Grocer Sues Title Insurer For Coverage In Property Row

Law360, New York (August 9, 2010, 5:09 PM EDT) -- Nash-Finch Co. is seeking defense coverage from First American Title Insurance Co. for a suit the grocer brought over Jack In The Box Inc.'s planned construction of a restaurant on property Nash-Finch leases in Colorado.

Nash-Finch filed a complaint Friday in the U.S. District Court for the District of Minnesota that the claims and defenses it asserted in the Colorado litigation are covered by an insurance policy from First American and that the insurer had a duty to defend the company in the litigation.
