US Fire Wants Off Hook For Mich. Homeowner Action

Law360, New York (August 9, 2010, 12:52 PM EDT) -- United States Fire Insurance Co. has launched a suit seeking a declaration that it does not owe coverage to Warren, Mich., in an underlying class action brought by residents whose property was allegedly damaged by the city's tree-planting program.

The city's inability to inform U.S. Fire of the known risks of its tree-planting program coupled with several exceptions in the subject general liability policies precludes the insurer from having to attend an Aug. 10 mediation conference in the class action, according to a complaint filed Friday...
