CIT Wants Info On Tianjin Magnesium Byproduct Value

Law360, New York (August 10, 2010, 3:26 PM EDT) -- A federal judge has ordered the U.S. Department of Commerce to explain why it classified byproduct from Tianjin Magnesium International Co. Ltd.'s exports as higher-value unwrought magnesium as opposed to lower-value “slag” waste.

Judge Nicholas Tsoucalas' ruling, issued Monday in the U.S. Court of International Trade, said Commerce failed to adequately explain its decision to value the magnesium byproduct at a higher level when calculating anti-dumping duty margins for the Chinese company.
