Plaintiffs' Atty Barred From Using Leaked Zyprexa Docs

Law360, New York (August 13, 2010, 2:11 PM EDT) -- A federal appeals court has upheld a permanent injunction that will prevent a plaintiffs' lawyer from further distributing confidential documents related to the Zyprexa product liability litigation against Eli Lilly & Co.

The plaintiffs' lawyer, James Gottstein, helped expert witness David Egilman violate a protective order through the use of sham subpoenas, and the lower court therefore had the power to enjoin him in these circumstances, a three-judge panel of the U.S. Court of Appeals for the Second Circuit ruled Thursday.
