Hulu, WildTangent Get Web Media Patent Suit Nixed

Law360, New York (August 17, 2010, 5:13 PM EDT) -- A federal judge has thrown out a lawsuit claiming Hulu LLC and WildTangent Inc. infringed a patent for the distribution of copyrighted content over the Internet, finding that the innovation does not cover patentable subject matter.

Judge R. Gary Klausner of the U.S. District Court for the Central District of California on Friday agreed to dismiss Ultramercial LLC’s suit in light of the U.S. Supreme Court’s decision in Bilski v. Kappos, holding that the patent failed the machine-or-transformation test and claimed an abstract idea.
