Nike Fraud Suit Against Lombardi Licenser Survives

Law360, New York (August 17, 2010, 2:26 PM EDT) -- A company specializing in licensing the images of deceased celebrities has failed in its bid to dismiss a breach of contract and fraud lawsuit brought by athletic apparel giant Nike Inc. over a nonexistent recording of famed football coach Vince Lombardi.

Magistrate Judge Dennis J. Hubel of the U.S. District Court for the District of Oregon on Aug. 11 ruled that Nike could pursue its claims alleging CMG Worldwide Inc. collected a $150,000 licensing fee for the use of the words and audio from a speech...
