U. Of Phoenix Counselors' OT Claims Moved To Pa.

Law360, New York (August 17, 2010, 11:06 AM EDT) -- A federal judge has refused to certify a group of enrollment counselors' wage-and-hour suit against the University of Phoenix as a collective action, instead transferring the employees' federal claims to a first-filed action in another court.

Judge Lawrence K. Karlton in the U.S. District Court for the Eastern District of California on Friday declined to certify the plaintiffs' Fair Labor Standards Act claims, saying they belong in the first-filed action in the U.S. District Court for the Eastern District of Pennsylvania.
