6th Circ. Partially Revives Wyeth Redux Liability Suit

Law360, New York (August 18, 2010, 6:49 PM EDT) -- A federal appeals court partially reinstated a suit over Wyeth diet pill Redux on Wednesday, saying the fact that federal regulators signed off on the fen-phenlike drug did not preempt claims that the company was negligent in bringing the drug to market in the first place.

The U.S. Court of Appeals for the Sixth Circuit reversed the dismissal of Mary Buchanan's negligence claims over Wyeth's actions prior to approval as well the dismissal of her related bid for punitive damages. But the three-judge panel affirmed the...
