Premier's Arbitration Bid Nixed In Rival's Antitrust Suit

Law360, New York (August 20, 2010, 2:17 PM EDT) -- A federal judge has shot down a bid by Premier Purchasing Partners LP to compel arbitration in rival Freedom Medical Inc.'s lawsuit accusing Premier and others of conspiring to monopolize the $450 million medical equipment rental industry.

In a ruling Thursday, Judge David Folsom of the U.S. District Court for the Eastern District of Texas rejected Premier's motion to dismiss the case and compel arbitration, saying it wasn't immediately clear the parties had a “binding and enforceable” arbitration agreement.
