Mining Cos. Lose Bid To Nix Tribe's Superfund Fight

Law360, New York (August 24, 2010, 3:39 PM EDT) -- A federal judge has refused to dismiss a long-running suit brought by the Quapaw tribe of Oklahoma accusing two mining companies of tainting tribal lands, shooting down the argument that the case can't move forward without the state as a party.

Judge Claire V. Eagan of the U.S. District Court for the Northern District of Oklahoma ruled Friday that the suit can proceed without the state because the tribe is seeking damages related to natural resources on tribal lands over which the state has no authority....
