Dallas Cabbies Lose Bid To Enjoin Natural Gas Rule

Law360, New York (September 1, 2010, 5:35 PM EDT) -- A federal judge has denied a group of Dallas taxi drivers' bid for a preliminary injunction against a city ordinance giving preference to natural gas-fueled cabs, ruling that the Clean Air Act does not preempt the local law.

Judge Ed Kinkeade of the U.S. District Court for the Northern District of Texas ruled Monday that the CAA was meant more for establishing manufacturing standards for new cars and did not apply in this case, dealing a blow to the Association of Taxicab Operators USA.
