Brooks Bros. Loses On Appeal In False Marking Suit

Law360, New York (August 31, 2010, 4:43 PM EDT) -- The U.S. Court of Appeals for the Federal Circuit on Tuesday reversed a district court ruling in a false marking suit against Brooks Brothers Inc., finding that the plaintiff — a patent attorney who accused Brooks Brothers of falsely marking its adjustable bow ties with expired patents — had qui tam standing and that the federal government had the right to intervene in the case.
