Philip Morris' Appeal Of Smokers' Class Cert. Denied

Law360, New York (September 2, 2010, 11:55 AM EDT) -- A federal appeals court has barred a Philip Morris USA Inc. interlocutory appeal challenging the certification of a class of Massachusetts smokers who accuse the company of design defects, negligence and breach of implied warranty and seek to force it to pay for medical monitoring to detect early signs of lung cancer.
