10th Circ. Upholds Solvay Win In Age Discrimination Suit

Law360, New York (September 10, 2010, 6:46 PM EDT) -- A federal appeals court has largely upheld a ruling that Solvay Chemicals Inc. did not violate age discrimination laws when it switched to a pension plan that reduced benefit accruals for older employees.

In mostly affirming the U.S. District Court for the District of Wyoming's 2009 dismissal of a class action against the company by its employees, the U.S. Court of Appeals for the Tenth Circuit ruled Tuesday that Solvay gave its employees fair notice of benefit changes when it adopted the new plan in 2005....
