DOI Loses Bid To Kill $173M Pipeline Contract Spat

Law360, New York (September 10, 2010, 4:08 PM EDT) -- The U.S. Civilian Board of Contract Appeals has refused to dismiss claims by Rockies Express Pipeline LLC that the federal government breached an agreement related to the transport of natural gas by failing to pay reservation charges of at least $173 million.

A three-judge panel of the appeals board on Wednesday rejected the U.S. Department of the Interior's arguments that the precedent agreement at issue with Rockies Express didn't qualify as a contract and that the board lacked jurisdiction over the dispute.
