Medtronic Whistleblower's Kickback Suit Tossed

Law360, New York (September 10, 2010, 2:26 PM EDT) -- A federal appeals court has dealt an apparent final blow to a would-be whistleblower's quest to sue doctors and medical equipment distributors who were allegedly part of a kickback scheme with Medtronic Inc.

The U.S. Court of Appeals for the First Circuit on Wednesday affirmed a March 2009 lower court ruling that dismissed Jacqueline Kay Poteet's qui tam action against Bahler Medical Inc. and several physicians under the False Claims Act, blasting her complaint as “parasitic.”
