Export Packaging Workers Lose WARN Class Cert. Bid

Law360, New York (September 16, 2010, 3:36 PM EDT) -- Former workers of Export Packaging Co. Inc. who say the company failed to give them proper notification before laying off 225 employees have lost their bid to certify the case as a class action.

Judge Joe Billy McDade of the U.S. District Court for the Central District of Illinois issued the ruling Wednesday, saying the named plaintiffs did not offer enough evidence that the 225 workers they seek to represent could actually be members of the proposed class.
