Law360 (September 21, 2010, 2:22 PM EDT) -- In December of 2009, the United States filed suit[1] against chemical companies, insurers and several plaintiffs' attorneys who participated in the $300 million Abernathy class action settlement. The defendants and their insurers entered into the Abernathy settlement in 2003, to resolve claims related to alleged exposure to PCBs. The plaintiffs' attorneys in Abernathy received certain of the proceeds of the settlement in their escrow account, from which they ultimately distributed settlements to individual claimants and obtained their fees, allegedly without reimbursing Medicare for medical payments associated with plaintiffs' claims....
