CVS Loses Fight Over Collective Status In OT Suit

Law360, New York (September 22, 2010, 4:13 PM EDT) -- A judge has granted a request by a CVS Pharmacy Inc. assistant store manager to drop a proposed collective action in favor of a smaller suit, against the objections of the drug store chain.

In an order issued Tuesday, Judge Vanessa L. Bryant of the U.S. District Court for the District of Connecticut said the post-discovery motion to amend the Fair Labor Standards Act complaint, dropping the collective action and adding three individual plaintiffs, was not untimely or improper, as CVS had argued.
