Trudeau, FTC Spar In 7th Circ. Over $37.6M Penalty

Law360, New York (September 24, 2010, 4:58 PM EDT) -- A lawyer for embattled weight-loss guru Kevin Trudeau on Friday urged a federal appeals panel to erase a $37.6 million restitution ruling in a long-running false advertising case, saying the lower court abused its discretion to dole out civil contempt penalties under the Federal Trade Commission Act.

Trudeau, at most, should be on the hook for the amount he actually pocketed — $1.5 million — rather than the $37.6 million consumers spent on his book "The Weight Loss Cure," Winston & Strawn LLP's Kimball R. Anderson...
