Judge To Hear Gryphon Fraudster's Bipolar Claim: Atty

Law360, New York (September 24, 2010, 5:49 PM EDT) -- The judge hearing the case of financial manager Kenneth Marsh, who stands accused of conning investors out of millions by lying about his qualifications, will likely allow expert testimony claiming that Marsh's untreated bipolar disorder made him incapable of forming criminal intent.

Judge Jack B. Weinstein of the U.S. District Court for the Eastern District of New York will wait for an Oct. 20 hearing to make a final determination on the psychiatric testimony’s admissibility, Marsh’s attorney Fred Schwartz of Adorno & Yoss LLP told Law360....
