High Court To Hear Product Cases Against Foreign Cos.

Law360, New York (September 28, 2010, 4:44 PM EDT) -- The U.S. Supreme Court decided Tuesday to hear in tandem two products liability cases that center on whether state courts can assert jurisdiction over foreign manufacturers that sell allegedly defective items in the U.S. through a third-party distributor.

The manufacturers say allowing jurisdiction could make foreign companies think twice about doing business in the U.S. and put American companies at risk of similar litigation overseas. But the plaintiffs say American consumers would be left unprotected if they can't sue foreign corporations in U.S. courts.
