FCA Qui Tam Suit Heads To High Court

Law360, New York (September 28, 2010, 5:55 PM EDT) -- In a case involving the world’s second-largest elevator maker, the U.S. Supreme Court has agreed to rule on whether a whistleblower can file suit under the False Claims Act based on information obtained through a Freedom of Information Act request.

The nation’s high court on Tuesday granted a petition for a writ of certiorari lodged by Schindler Elevator Corp. protesting an appeals court’s decision that FOIA requests don’t trigger jurisdictional restrictions on qui tam claims.
