Class Cert. Put On Hold In Acer False Marketing Suit

Law360, New York (September 29, 2010, 4:46 PM EDT) -- Acer America Corp. has convinced a federal judge not to certify a class — at least not yet — in a suit accusing the technology company of falsely marketing its computers as including the Microsoft Windows operating system.

Judge James Ware of the U.S. District Court for the Northern District of California on Tuesday denied the plaintiffs' motion for class certification without prejudice, saying it was premature and calling for additional discovery.
