FedEx Bid To Dismiss Discrimination Case Fails

Law360, New York (March 5, 2007, 12:00 AM EST) -- Arab-American drivers who were allegedly called “terrorists” while working at FedEx Ground Package System Inc. have received the green light to sue the company under Massachusetts' anti-discrimination law.

FedEx had argued that the four Arab-American drivers who filed the complaint are independent contractors and ineligible for protection under the state's anti-discrimination law. The Massachusetts Commission Against Discrimination ruled against FedEx’s motion to dismiss the complaint on Feb. 14.

Whether the drivers have been misclassified as independent contractors is also at issue in a national class action...
