Officers Class Decertified In FLSA Suit Against HSBC

Law360, New York (September 30, 2010, 3:13 PM EDT) -- HSBC Mortgage Corp. has succeeded in decertifying a conditional class of loan officers who accused the company of denying them overtime pay.

Judge Maxine M. Chesney of the U.S. District Court for the Northern District of California on Wednesday sided with HSBC, finding that individualized investigations will be necessary to determine whether those employees were properly classified as outside salespeople and thus exempt from the Fair Labor Standards Act's overtime requirements.
