Pampers Licensee, P&G Face False Marking Suits

Law360, New York (October 11, 2010, 2:08 PM EDT) -- Texas Data Co. LLC has slapped Procter & Gamble Co. and Evercare Co. with separate qui tam suits accusing the companies of falsely marking detergent for children’s clothes, diaper kits and other products with expired patents.

P&G knew or should have known that its UnderJams Night Wear and Dreft liquid and powder detergents, which are intended for baby clothes, were marked with expired patents, according to a complaint filed Friday in the U.S. District Court for the Eastern District of Texas.
