Calif. Appeals Court Nixes RIAA Restitution Award

Law360, New York (October 12, 2010, 8:11 PM EDT) -- A California appeals court has held that the Recording Industry Association of America, a music industry trade group, was not a direct victim of two criminal defendants’ storage and sale of counterfeit compact discs and should not have received a restitution award.

California’s Fourth District Court of Appeal on Tuesday reversed a trial court’s rulings that directed Micah Akeem Kelly and Robert Trongale to pay nearly $15,000 in restitution to the RIAA.
