Judge Allows $8.7M Ruling In Vioxx Case To Stand

Law360, New York (March 8, 2007, 12:00 AM EST) -- Merck & Co. Inc. faced a setback in one of its Vioxx product liability disputes Monday when a Texas state court judge opted not to overturn an $8.7 million judgment issued against the company last year after a jury trial.

Merck had requested a new trial shortly after Texas State District Court Judge Alex W. Gabert issued his ruling in December. Judge Gabert had 75 days to consider the request but let the March 5 deadline pass without taking action, effectively denying Merck’s motion.
